Certain interpretations of the current Waste Framework Directive are undermining fundamental established principles of ‘suitability for use’ and ‘risk based land management’ in use in Europe. Under current interpretations, opportunities are being lost to reuse treated and untreated soils, restrictions are being placed on treatment and regeneration processes, and this is placing a greater burden on landfill and the use of primary, quarried, replacement.


Waste or Not Waste?

NICOLE’s interest in waste legislation is in relation to contaminated and uncontaminated soils, soil treatment, and materials generated by brownfield regeneration. NICOLE is supportive of the idea of Europe as a recycling society, and believes that industry has a significant role to play in ensuring the sustainable management of these materials.

The Waste Working Group is led by Ian Heasman of Taylor Woodrow Developments and includes active members from industry, service providers and academia.

Waste Working Group Objectives

The Waste Working Group has the objective of supporting productive revisions to the Waste Framework Directive to enable a consistent approach to soil management in Europe in a way that:

 

·    Supports the sustainable reuse, recycling and recovery of contaminated soils and related materials

 

 

·    Clarifies when contaminated soil and related materials are waste and when theycease to be waste, including risk based fit-for-purpose protocols

 

 

·   Supports proportionate risk based permitting and exemptions

 

 

·   Supports breaking the linkage between treated contaminated soils and their classification as waste earlier in the chain of custody

 

      ·    Resolves Van De Walle

 

      ·   Analyses the key issues and communicates findings in support of NICOLE’s overall goals
